This website is operated by ORLIVET (“we”, “us”, “our”). By visiting or purchasing from orlivet.com, you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, customers, merchants, and contributors.
We reserve the right to update, change, or replace any part of these Terms at any time. It is the customer’s responsibility to review this page periodically for changes.
Use of this website constitutes acceptance of these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products from ORLIVET. We may refuse service to anyone at any time for any reason.
3. Product Information & Availability
All ORLIVET pieces are crafted in small batches. Availability is not guaranteed.
We strive for accuracy in depictions of stones, metals, colors, sizes, and craftsmanship; however, natural and hand-finished variations are expected and are not considered defects.
We reserve the right to discontinue products at any time.
4. Pricing & Payments
All prices are listed in USD unless otherwise stated.
Pricing may change at any time without notice.
Payments are processed through secure, encrypted third-party gateways.
We may refuse or cancel any order suspected of fraud or misuse.
5. Shipping & Delivery
Complimentary worldwide shipping is included with every order.
By purchasing from ORLIVET, the customer agrees to the following:
• Estimated delivery times range from 3 to 30 business days.
• Certain destinations and circumstances (customs delays, logistics disruptions, natural events) may extend delivery beyond 30 days.
• ORLIVET is not liable for delays caused by carriers, customs, force majeure, or incorrect customer information.
• Once a shipment is released to the carrier, liability for delivery timelines transfers to the carrier.
• All orders are shipped with insurance covering the declared value until the moment of confirmed delivery.Refused deliveries, incorrect addresses, or unclaimed parcels may incur additional fees at the customer’s expense.
6. Exchanges (Size Exchange Only)
ORLIVET provides a 30-Day Size Exchange, subject to the conditions below:
1. The exchange applies strictly to changing the size of the same design.No design changes, metal changes, or gemstone changes are permitted.
2. Each customer is entitled to one exchange per order.
3. Return shipping to ORLIVET is paid by the customer.Reshipment after the size adjustment is complimentary.
4. Items must be returned unworn, undamaged, and in original condition.Items showing wear, resizing attempts, scratches, or damage may be refused.
5. The resizing or remaking process may take up to 30 days, and in rare cases longer due to production queue or material availability.
6. We reserve the right to refuse an exchange that does not meet eligibility criteria.Custom, engraved, altered, bespoke Atelier pieces are non-exchangeable unless explicitly stated.
7. Returns & Refunds
ORLIVET does not offer cash refunds on purchases except where legally required.
Exchange-only policy applies worldwide.
If an order is returned due to refusal of delivery, unpaid duties, or incorrect address, additional administrative or shipping fees may apply.
8. Repairs & Lifetime Care
We offer lifetime inspection of stone settings and complimentary polishing for ORLIVET gold jewelry.
Damage caused by wear, misuse, impact, accidental force, or exposure to chemicals is not covered under complimentary service and may incur repair fees.
Unauthorized repairs or alterations void all warranties and services.
9. Gemstone Disclosure
ORLIVET uses natural, lab-grown, and enhanced gemstones.
Stone treatments (including heat treatment, irradiation, and enhancement) comply with international gemological standards.
Natural stones, including Volyn topaz and other mined materials, may contain inclusions or tonal variations; such characteristics are inherent and not defects.
Third-party stones may rely on miner- or cutter-provided documentation.
ORLIVET is not responsible for inaccuracies originating from third parties.
10. International Customs, Duties & Taxes
Orders shipped outside the customer’s domestic country may incur import duties, VAT, or customs charges. These fees are the sole responsibility of the customer.
Failure to pay customs duties may result in the parcel being returned or destroyed by customs. ORLIVET is not liable for such outcomes.
11. Accuracy of Website Information
Occasional errors, omissions, or inaccuracies may appear in product descriptions or availability.
We reserve the right to correct such errors at any time without notice.
12. Prohibited Uses
Users may not:
• violate laws or regulations,
• engage in fraudulent activities,
• resell products without written consent,
• interfere with site functionality, security, or infrastructure,
• infringe upon our intellectual property.Violation may result in termination of service.
13. Limitation of Liability
To the fullest extent permitted by law, ORLIVET is not liable for:
• indirect, incidental, punitive, or consequential damages,
• delays in shipping,
• carrier errors or customs issues,
• post-delivery loss or theft,
• unauthorized third-party repairs or alterations.Our maximum liability is limited to the purchase price of the product.
14. Governing Law (U.S. + EU + Ukraine)
These Terms are governed primarily by the laws of Ukraine, where ORLIVET operates.
However:
• For U.S. customers: mandatory consumer protections under U.S. federal and state law apply.
• For EU customers: applicable EU consumer protections apply except where EU law explicitly provides exemptions (see Section 15 and 16 below).Any disputes shall be handled in the courts of our operational jurisdiction unless otherwise required by mandatory law.
15. EU Consumer Rights & Withdrawal Law
Under EU Directive 2011/83/EU, some goods qualify for a 14-day withdrawal period.
ORLIVET jewelry does not, because:
• Most pieces are made-to-order or size-adjusted.
• Personalized goods are exempt from the withdrawal right under Article 16(c) of the Directive.Therefore:
EU customers acknowledge that ORLIVET jewelry is custom-crafted and not eligible for standard EU withdrawal returns.
We voluntarily provide a 30-day size exchange, which exceeds typical EU industry practice.
16. U.S. Consumer Protection & Compliance
We comply with relevant U.S. consumer fairness laws.
However:
• Refunds are not required unless the product is legally deemed defective.
• ORLIVET reserves the exclusive right to determine defectiveness.
• Delays, minor variations, or size issues do not qualify as defects.This fully protects your business from arbitrary U.S. returns.
17. Digital Certificates & Authentication
Some ORLIVET pieces include a Digital Certificate accessed via QR code or digital link.
By using the Digital Certificate, the customer agrees that:
1. Informational Use OnlyDigital Certificates provide information for authentication and record purposes only.
They are not financial evaluations or investment documentation.
2. Non-Binding VariationsMeasurements, stone weight, color, cut details, and origin information may include minor variations.
Such variations are not defects.
3. Third-Party SourcesORLIVET may rely on documentation from miners, cutters, or suppliers.
We are not responsible for third-party inaccuracies.
4. Technical Failures Not Our LiabilityQR code errors, website downtime, certificate display issues, or incompatible devices do not constitute grounds for claims.
5. Certificate UpdatesORLIVET may update or correct Digital Certificates at any time to reflect more accurate or complete information.
6. Non-TransferabilityCertificates cannot be transferred independently of the jewelry item and do not establish additional ownership rights.
18. Severability
If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions remain valid and enforceable.
19. Termination
We may terminate or suspend access to the website or services at any time for violations of these Terms.

ORLIVET — Shipping Policy

1. Complimentary Worldwide Shipping
ORLIVET offers free worldwide shipping on all orders, regardless of destination or order value. Every piece is packaged securely, discreetly, and shipped with insurance coverage until confirmed delivery.
2. Estimated Delivery Times
Delivery times vary based on destination, production queue, customs, and carrier capacity.
Estimated delivery window: 3 to 30 business days Some regions or circumstances may extend delivery beyond 30 days.
By placing an order, the customer acknowledges that delivery timelines are estimates, not guarantees.
3. Production & Processing Times
Many ORLIVET pieces are made to order or adjusted individually.
Processing before shipment may take: 5–15 business days, sometimes longer during peak seasons, custom stone selection, or complex size adjustments.
These processing periods are separate from carrier transit times.
4. Customs, Duties & Local Taxes
International orders may be subject to: • VAT • Import duties • Local customs charges
These costs are the responsibility of the customer. Unpaid customs fees may lead to return, rejection, or destruction of the parcel by customs authorities. ORLIVET is not liable for such outcomes.
5. Delivery Confirmation & Risk Transfer
• All shipments include tracking and full insurance until delivery confirmation. • Once the carrier marks the package as delivered, responsibility transfers to the customer. • ORLIVET is not liable for theft, loss, or damage occurring after confirmed delivery, including packages stolen from mailboxes, doors, or building lobbies.
This is standard practice for luxury brands (Cartier, Tiffany, VRAI).
6. Incorrect Address / Failed Delivery
If a package is returned due to incorrect address, refusal, or failure to collect: • Reshipment fees may apply • Customs duties may be charged again • Refunds are not issued • Exchange eligibility may be voided
Addresses must be entered accurately. ORLIVET cannot modify addresses after dispatch.
7. Shipping During Exchanges
For size exchanges (see Terms of Service): • Customer pays return shipping to ORLIVET • ORLIVET covers the shipping cost of the replaced item back to the customer
Returned items must meet all exchange requirements.
8. Force Majeure & Logistics Delays
ORLIVET is not responsible for delays caused by: • Natural events • Customs inspections • Carrier disruptions • Political instability • Global logistical failures • Peak holiday volume
Such delays do not qualify for refunds or compensation.
